  1. SUBJECT - SCOPE

1.1. General Principales

These General Terms and Conditions of Use (hereinafter referred to as “the GTCU “aim to define the terms and conditions according to which:

  • The company STIMUPRAT EDITIONS (hereinafter referred to as « STIMUPRAT ») as identified in the Legal Notice on the website makes available to its users the website www.cardiocases.com (hereinafter referred to as « the Site ») and the services available on the Site,
  • the user accesses the Site and uses its services.

The user is understood as any natural person who visits, consults or uses the services available on the Site for personal or professional purposes.

1.2. Goals of the web site

The Site is intended to allow users:

  • To consult annotated and commented ECG tracings by type of cardiac prosthesis and by manufacturer,
  • To prepare for the examinations of rhythmologie and to carry out trainings online,
  • To conduct online quizzes on ECG analysis,
  • To get information on the agenda of the trainings organized by STIMUPRAT,
  • To consult ECG analysis videos,
  • To exchange in the framework of the layout forum,
  • to be informed of the news of STIMUPRAT,
  • apply for STIMUPRAT trainer status.

1.3. Acceptance of the General Terms and Conditions of Use

The consultation of the Site implies the full and unreserved acceptance of the user to the General Terms and Conditions of Use.

It is therefore the responsibility of the user who wishes to consult the Site and/or use the services it proposes to read the General Terms and Conditions of Use.

1.4. Tolerance - Changes

The fact that STIMUPRAT does not prevail at a given moment of any of the stipulations of the GTCU cannot be interpreted as a waiver of the latter to avail itself later of any of said stipulations.

STIMUPRAT reserves the right to modify the GTCU at any time. In such circumstances, it will inform the user by e-mail, when it is available, or by means of an information message published on the Site.

  1. OPENING A USER ACCOUNT

2.1. The user can consult the Site free of charge and without any obligation of registration.

However, the user must first create a user account and identify himself in order to:

  • Apply for the status of trainer,
  • Participate in the forum posted on the Site,
  • Be informed of the posting of a new discussion topic on the forum,
  • Be informed of the posting of news, quizzes and training.

2.2. In order to create a user account, the user must fill in the registration form provided for this purpose on the Site. The opening of a user account includes the entry of four identifiers: the user's first and last names, an e-mail address and a password.

User IDs are personal and must be kept confidential. The user is responsible for the use of his identifiers and is prohibited from disclosing them to a third party or giving them up. Any use of the user's personal account is deemed to be performed by the user.

It is up to the user to immediately inform STIMUPRAT in writing of any use of his / her identifiers made without his knowledge so that STIMUPRAT deactivates the said identifiers.

It is the responsibility of the user to provide accurate and complete information and to ensure that they are updated in the event of subsequent changes. In the absence of updating the user information, STIMUPRAT cannot be held responsible for the lack of reception by the user of information.

At the end of the registration process, STIMUPRAT will send the user an email confirming his registration and summarizing the information provided by the user for registration purposes.

STIMUPRAT reserves the right to suspend access to the Site in the event of fraudulent use or attempted fraudulent use of the user's credentials. In case of suspension of access, STIMUPRAT will inform the user.

  1. ResponsIbilITY FOR CONTENT POSTED

3.1. Content posted by STIMUPRAT

The information presented on the Site is provided in good faith and in the current state of knowledge. STIMUPRAT endeavors to ensure to the best of its ability, the accuracy and updating of the information on the Site, which it reserves the right to correct, at any time and without notice, the content.

STIMUPRAT reserves the right to delete information and data if it considers that their content is illegal, does not comply with the regulations in force or that does not correspond to the spirit, purpose, image and values ​​attached to the Site and / or which is likely to harm STIMUPRAT and / or third parties.

Tracings and comments are posted online by STIMUPRAT on the Site so that users can make them available to the public or reproduce them for teaching or scientific research purposes, each user must strictly comply with the provisions of Article L.122-5 of the Intellectual Property Code when applicable.

The comments associated with the tracings are presumed to be protected by copyright and cannot be commercially exploited by the user.

These comments do not constitute, directly or indirectly, a medical consultation and the user will not be able to implement the information available on the Site in support of the formulation of a diagnosis.

3.2. Content posted by the user

The Site allows the user to view information published by STIMUPRAT but also allows him to ask a question about an ECG tracing, to present an ECG or EGM as part of the tracing forum.

The user who publishes content is responsible to STIMUPRAT and third parties for the information and data that it puts online and more generally for the elements sent to STIMUPRAT.

In this context, the user must beware of the information he broadcasts and uploads online and is committed to the utmost truthfulness and veracity of the information he posts online.

In addition, the user must imperatively anonymize the lines before putting them online in the framework of the forum, no information to allow the identification of patients.

Any content posted on the Site may be immediately removed by STIMUPRAT if there is a finding of lack of anonymity or imperfect anonymity, without prejudice to any damages and interest borne by the user due to the damage caused by uploading non-anonymized content.

The user must also respect the aim and purpose of the Site.

The user is prohibited as such from posting online comments, information, photographs or elements that include:

  • infringe intellectual property rights held by third parties (such as copyrights, trademarks, designs),
  • infringe the privacy, image rights or reputation of a third party,
  • would be contrary to public order, morality or the feelings of minors,
  • would be disparaging, defamatory or insulting.

More generally, the user guarantees the lawful character of the elements and information that he puts on line and is prohibited from using the Site to exercise an illegal activity, illegal, contrary to public order and / or morality.

It is further strictly forbidden for the user to use the Website for advertising or promotional purposes.

It is specified that any violation or non-compliance with this article constitutes a breach by the user to the GTCU authorizing STIMUPRAT to remove the illegal content, suspend or terminate immediately and automatically the registration of the user, without compensation to the benefit of the user and without prejudice to the damages that could be owed by the user to STIMUPRAT as such.

In any event, in the case that STIMUPRAT's liability is questioned by a third party because of the content published by a user, the user concerned should be uninjured STIMUPRAT of all the convictions and indemnities that would be borne by it, including the costs of proceedings, advice and disbursements incurred by STIMUPRAT.

3.3. Reportions illegal content

The user who notices in the Site a content that is illegal and / or non-compliant with the GTCU (such as a statement contrary to morality or that offends a third party) may immediately inform STIMUPRAT by sending a message to the e-mail address next: contact@stimuprat.fr.

In the event of reporting of illegal content and / or non-compliance with the GTCU, STIMUPRAT will have the option of suspending or canceling immediately and without notice the information concerned, and may under the same conditions, if necessary, terminate the registration of the user who has published the illegal content and does not comply with the GTCU, without prejudice to the damages that could be owed by the user to STIMUPRAT as such.

  1. Accessibility of the website

The Site is accessible 24 hours a day, 7 days a week, except in case of major case, possible breakdowns or maintenance interventions necessary to ensure the proper functioning of the Site.

STIMUPRAT commits to make its best efforts to ensure users access to the Site at all times. However, it provides no guarantee regarding both the availability or accessibility of the Site, the absence of viruses.

STIMUPRAT cannot be held responsible for the difficulties of access or temporary inability to access the Site due to network disruptions, the user being informed of the complexity of the global networks and the influx, at certain times, of users of Internet. The same is true of any piracy or virus intrusion that may occur, as STIMUPRAT cannot guarantee absolute protection of the Site.

Furthermore, STIMUPRAT shall not be liable for any damage, temporary or permanent, caused to the user's computer system, or any loss or damage (including, but not limited to, loss of data or profits) that would be suffered by the user following:

With the exception of comments related to the ECG tracings (see Article 3.1 of the General Terms and Conditions of Use), any use, reproduction or partial or full download on any medium whatsoever of any of the elements of the Site, text, images, photographs, illustrations, logos, without the prior written consent of STIMUPRAT, is strictly prohibited.

Any infringement of this article is likely to be penalized and civilly sanctioned in particular for the purposes of counterfeiting and may result in the payment of damages.

STIMUPRAT may also, at its discretion, terminate the registration of the user immediately.

Clicking on the hypertext links inserted on the Site may direct the user to other websites.

STIMUPRAT assumes no responsibility for the links and for the content of the website to which the user can be redirected. Users choosing to access the websites of third parties are subject to the conditions of use of these sites.

7.     APPLICABLE LAW

The General Terms and Conditions of Use are subject to French law.

Consequently, unless otherwise provided by public order, the relationship between the user and GTCU - because of the use of the Site - will be governed by French law.
